Residents of the luxury condo-hotel complex The St. Regis Bal Harbour in Miami Beach have reached an out-of-court settlement with their Qatari owner, ending a lawsuit filed last year that alleged serious building defects.
The suit was dismissed with prejudice in August after the agreement was reached, meaning the claim cannot be re-filed. The condo association representing 204 units—the Bal Harbour North South Condominium Association—had accused the owner, an affiliate of Al Rayyan Tourism Investment Co. (ARTIC), of neglecting structural issues and covering up conditions including mold and possibly compromised concrete.
As part of the settlement, a testing and remediation plan will be carried out by a third-party to address the defects raised in the complaint. The exact terms of the settlement remain confidential.
“This settlement ensures that our buildings will remain safe, secure, and visually stunning,” said association President Gregory Sachs. “We are excited to partner with Seldar and Marriott and make our community truly best-in-class.”
ARTIC, a subsidiary of Qatari investment firm Al Faisal Holding Co., owns the hotel portion of the property, while Marriott International manages the St. Regis brand and operates the hotel element.
The original lawsuit, filed in November 2024, raised allegations of mold colonies, cracking concrete, flooding, exposed wiring, and posting of temporary structural supports in the parking garage. One claim described barrels labeled “ACID” in the garage and warned that inadequate maintenance might lead to collapse if untreated.
In their response, the defendants had disputed the need for court-ordered relief, stating that they had already engaged engineers and contractors to address the issues and that no expert opinion supported an imminent collapse risk.
With this settlement, the focus now shifts to executing the remediation plan and restoring confidence among the condo residents. The association and owners have indicated cooperation to ensure the property is brought up to standard.
